Abstract This note addresses whether the (D)CFR could serve as an optional instrument for contract law. The note identifies the advantages and disadvantages of an optional contract law instrument and some problems that must be overcome. It also discusses its possible content of such an instrument and finally addresses the question of the legal basis.
