Kanttekeningen bij de nieuwe zelfstandigheid

Dit artikel plaatst kanttekeningen bij het fenomeen van de nieuwe zelfstandigheid op basis van recente (internationale) studies naar zelfstandigheid in de bouwsector. Het aantal zzp’ers in Nederland is de afgelopen jaren gestaag gegroeid. Zzp’ers zijn in geen wet- of regelgeving terug te vinden. Soms wordt gedoeld op freelancers, soms op alle zelfstandigen zonder personeel in dienst. Na een behandeling van enkele problemen die samenhangen met het ontbreken van een eenduidig wettelijk kader wordt nagegaan welke gevolgen een verdere groei van de zelfstandigheid kan hebben voor een bedrijfstak. De ontwikkeling in de bouwsector in het Verenigd Koninkrijk toont aan dat er grote gevolgen kunnen zijn voor de kwaliteit en productiviteit door het ontstaan van ernstige opleidingstekorten. In het VK wordt getracht dit ad hoc op te lossen door het structureel aantrekken van goedgekwalificeerd buitenlands personeel.

The author looks at the phenomenon of self-employment, based on recent (international) studies of the self-employed in the construction industry. Self-employment is on the rise in the Netherlands. However, self-employment cannot be found in legal texts. Sometimes the term covers freelancers, in other situations it is applied for independent workers without personnel. After a paragraph that is dedicated to the problems related to the lack of a unified regulatory frame the author reflects on the consequences that a further growth of self-employment can have for a sector. The development of the construction sector in the UK makes clear that serious consequences come to the surface with regard to quality and productivity that are caused by substantial skill deficits. In the UK the ad hoc solution is the structural recruitment of foreign skilled labour.
