| Abstract |
This article explores the Polish Housing Specust Law (Lex Deweloper), enacted in 2018, which enables developers to bypass traditional spatial planning processes for residential projects. This law exemplifies a form of adaptive law that prioritizes and justifies flexibility and expedited processes to address pressing housing needs. While this adaptive framework allows for quicker decision-making and implementation, it introduces spatial conflicts, procedural inconsistencies, and significant procedural challenges, including undermining the coherence of long-term spatial planning and neglecting systemic considerations of equity, sustainability, and urban justice by focusing predominantly on short-term expediency. The aim of this article is to analyse how the implementation of the Housing Specust Law in Poland has led to spatial conflicts associated with court cases, considering both the types of actors involved and the main sources of these conflicts. The study analyses 123 court decisions, focusing on 83 relevant cases to evaluate complainants’ motivations, types of objections, and the implications of rulings for urban development. By studying these legal violations and their resolutions, we identified recurring patterns in how Polish legislators and courts justify or adjust the law in practice. This analysis allowed us to identify three distinct types of institutional reasoning or modes of justification used by lawmakers and judges to adapt or apply the Housing Specust Law. Situating the Specust Law within broader debates on adaptive law, the study highlights key reasons that flexibility is justified in institutional settings.
