| Abstract |
The Article gives an overview of recent developments in the EU, i.e. the CSRD and CSDDD Directives, related to sustainability and evaluates the current law from various perspectives including the role of the EU Emission Trading System, liability of companies and directors, national developments and case law including the caselaw related to the Shell climate cases. It concludes that the proposals do offer a way forward but that in view of climate change the best option is to further develop the EU Emission Trading System.
