Abstract This study looks at the response to the influenza A H1N1 pandemic within the institutional context of the EU. The focus is on what happens in practice in case of a health emergency in the EU, regardless of limited legislative basis in the area of public health. The institutional dynamics of actors on the European level and the policy they produced in response to the influenza A H1N1 are assessed in light of European constitutional principles. This shows the constitutional implications of the European response a public health emergency.
