Abstract This paper is the second (and final) part of a paper on the final version of the Modernisation Directive, adopted in 2019. In this second part I discuss the question with whom the consumer concludes a contract when that contract is concluded through an online marketplace, as well as some simplifications of the law to the benefit of traders, and the renewed rules on the right of withdrawal. In the conclusions I answer the main research question of the two papers: does the Modernisation Directive deliver on the promise made in the New Deal Communication?
