| Abstract | This contribution delves into the new legal landscape that came about with the entry into force of Protocol 16 to the ECHR. It first maps the extent of the potential conflicts that may arise when national (supreme) courts of the EU Member States can ask preliminary references to the European Court of Human Rights as well as to the Court of Justice of the European Union. To the extent that there are indeed possible conflicts the article proposes legal answers to deal with them. |
