Abstract In the nascent body of international criminal law, non-state participants, in particular individuals, have a prominent role not only as law-appliers, but more importantly as law-makers. This chapter demonstrates how individuals as well as other non-state participants form the normative content of the law, filling the gaps left by traditional state made law. Furthermore it is argued that individual participants in this process apply the law which they know from their own specific training and jurisdictional background, leading to a comparative law analysis of international criminal law.
