The article examines the transfer pricing implications of windfall profits in the energy sector during 2022, emphasizing the complexities of determining which entity within a multinational enterprise group should capture these unexpected gains. Against a backdrop of soared energy prices and recent European Union regulations for windfall taxes, the authors discuss challenges in applying the OECD Transfer Pricing Guidelines to allocate profits when market conditions yield unforeseen returns. They argue that while OECD guidelines prioritize significant people functions for profit attribution, the unexpected nature of windfall profits complicates the alignment with standard transfer pricing principles.
