Artikelen 93 en 94 Doorwerking en voorrang internationaal recht

This contribution provides a succinct introduction to the meaning and legal implications of these two articles of the Dutch Constitution on the domestic effect of certain forms of public international law, to wit, directly effective provisions of treaties and of decisions of international organizations. More importantly, it provides a reflection from the perspective of constitutional law of the plurality of legal orders. In this context, various issues concerning monism (which has uncritically been ascribed to the Netherlands approach to international law) and dualism and other pluralist alternatives.
