| Abstract | Should a trader be able to openly violate mandatory law without a regulator that can intervene? 'Of course not,' you will think. Nevertheless, that is the consequence of a judgment of the Trade and Industry Appeals Tribunal (CBb). The ruling of the CBb discussed in this paper shows that the administrative court has little understanding of private law or of the current housing market, or of both. |
