Abstract This article discusses the latest case-law from the European Court of Justice on how to deal with ‘trade mark applications in bad faith’. It briefly compares and contrasts the impact of the new MALASIA DAIRY decision with local practice in Denmark and the Benelux. The article also explains the latest developments on ‘bad faith’ in the proposed Trade Mark Directive.
