| Abstract |
Whether denying the issuance of an emergency passport to a Canadian national who was listed by the UN 1267 Committee as an ‘associate’ of Al-Qaida and, as a result, subject to a global asset freeze and global travel ban as set out in Resolution 1822, deprived him of his mobility rights under Subsection 6(1) of the Canadian Charter. Whether ‘territory’ in the travel ban set out in Resolution 1822 included airspace thereby placing Canada in breach of its international obligations if it were to provide any assistance to its own nationals flying to Canada through foreign airspace. |
